Weingarten Rights
- If an employee is being disciplined and asks for union steward, company must comply.
- If the requirements of the day don't allow for immediate availability of the steward, management must wait until the steward is available or provide a break for the steward to be present at the meeting.
- The steward should advise the employee to be calm and listen. Keep clear notes about what the employer is alleging
- Ask what facts the employer has. How did they obtain the facts? Advise the employer that the union will investigate the facts and respond within the timeline of the contract.
- Make the employer put things in writing and send them to the proper individuals with the union.
- Interview others on the crew who might have witnessed the incident, or have knowledge of the claim.
- Keep good notes. Forward the notes to the union representative. Make note of the incident on the steward's report.
- Do not slow work down or stop doing the job you were hired to do to complete this process. Follow up with people during break time or after the call. If that is not possible, and the situation needs immediate attention call the business agent of the local for support and follow up.
